What injuries or illnesses can I claim TPD insurance for?

A Total and Permanent Disability (TPD) insurance claim can be made for any injury or illness.  In order for your TPD insurance claim to succeed, you need to demonstrate, with written medical evidence, that you are not able to perform your employment long term.

It may be that one or multiple injuries or illnesses prevent you from performing your employment role.  The important part of making a TPD insurance claim is ensuring you have the right evidence to demonstrate what your injuries and/or illnesses are, and how they have affected your ability to work.  It is important to speak to a lawyer about getting the right evidence before submitting your TPD insurance claim application.  A lawyer can also take steps to assist in fast tracking your TPD insurance claim payment.

A TPD insurance claim may be made against a privately held insurance policy and/or an insurance policy held via your superannuation fund. Each policy of insurance is different and the evidence needed to make a claim should take into consideration the terms of the policy.  The general concept for a TPD insurance claim, whether it be made via a private insurance policy or your superannuation fund, is that if your injury or illness prevents you from working, you can make a claim.

You must have stopped work completely to make a TPD insurance claim. If you stop work and then start again you cannot make a claim until you have stopped working permanently because of your injuries or illness.

A lump sum TPD insurance claim can also be made if you have been assessed by a doctor as suffering a disability which results in you being accepted by Centrelink for a disability support pension.  For you to be able to make a claim, it is necessary for a TPD insurance policy to be held.  If you have previously worked and still have an existing superannuation fund, there will likely be an insurance policy attached to it that provides for a lump sum payment for permanent disablement.

If you have worked in various jobs over the years, it is possible you have more than one superannuation fund.  This means that you may be entitled to make more than one TPD insurance claim and receive lump sum payments under each policy held. If you are unsure whether you have a policy via your superannuation fund, MKF Lawyers can assist in finding out which superannuation policies exist.  If you have suffered an injury or illness and are no longer able to work, contact the team at MKF Lawyers on 08 7093 2998 or by email at info@mkflawyers.com.au for a free, no obligation discussion about your TPD insurance claim entitlements.  A lump sum payment may be available which you are missing out on if you take no action to claim it.
